These Terms & Conditions govern the use of the btu.ro website and the web hosting, cloud/VPS, dedicated server, domain registration and SSL certificate services provided by SND TEAM S.R.L. By creating an account, placing an order or using our services, you confirm that you have read, understood and fully accept these terms.
The btu.ro website and associated services are operated by SND TEAM S.R.L., a Romanian legal entity, hereinafter referred to as "BTU", the "Provider", "we" or the "Operator". The commercial brand under which we operate is "BTU".
The Provider's full identification details are as follows:
Within this document, the terms below have the following meaning:
As a reseller and integrator of infrastructure services, the Provider offers the Client a range of digital services hosted on EU infrastructure partners, in Tier III data centres. The Provider does not disclose the identity of its wholesale infrastructure suppliers; this in no way affects the quality or guarantees of the services offered.
The available services include, without limitation:
The contract is concluded remotely, electronically, at the moment the Client places an order, makes payment and receives confirmation from the Provider. The Client's order constitutes a firm offer to contract, and the contract is validly concluded upon the Provider's confirmation of acceptance.
To use the services, the Client must create an account by providing accurate, complete and up-to-date data. The Client is solely responsible for maintaining the confidentiality of their login credentials and for all activity carried out through their account. The Provider reserves the right to refuse or cancel orders in the event of erroneous data, suspected fraud or breach of these conditions.
By placing an order, the Client declares they have the legal capacity to contract and, in the case of legal entities, that they validly represent the entity on whose behalf they act.
All prices displayed on btu.ro are expressed in EURO (EUR) and represent final prices. SND TEAM S.R.L. is not registered for VAT; therefore prices do not include VAT and no VAT is added at invoicing. The Provider reserves the right to change service prices, with changes not applying to services already paid for during the current billing period.
Payment is made online, securely, through the Stripe payment processor (bank card) or other methods indicated during checkout. A proforma invoice is issued for each order, and upon payment confirmation a tax invoice is issued, sent electronically to the Client and available in their account.
The Client is responsible for the accuracy of their billing details. Any taxes, bank fees or exchange rate differences applied by the card-issuing bank are borne by the Client.
Web hosting services and SSL certificates are generally activated instantly (automatically), immediately after payment confirmation, with the Client receiving access details and configuration instructions by email.
Dedicated servers and some cloud/VPS configurations are usually provisioned within a few minutes to a few hours of payment confirmation, depending on hardware availability at the infrastructure partners and any anti-fraud checks. The Provider will make reasonable efforts to deliver as quickly as possible.
Domain registration depends on the registry competent for the respective extension; the Provider does not guarantee the availability of a requested domain until the registration is actually completed.
Services are contracted for a fixed period (monthly, quarterly, annually or multi-annually, depending on the product). The renewal due date is displayed in the Client's account and communicated through renewal notices sent in advance by email.
Renewal may be performed manually by the Client or automatically, where the Client has opted for recurring payment. It is the Client's sole responsibility to ensure the service is renewed before the expiry date and that payment details are valid.
Failure to pay by the due date may lead to suspension of the service and subsequently the irreversible deletion of associated data. For domain names, grace and redemption periods imposed by the registry may apply, with possible additional fees; the expiry of a domain may result in its loss.
In accordance with GEO 34/2014 on consumer rights in distance contracts, the Client who is a natural person acting as a consumer is, as a rule, entitled to withdraw from the contract within 14 calendar days, without penalty and without giving a reason.
Certain services are subject to exceptions and specific conditions regarding the right of withdrawal (for example domain registration, which is performed immediately and is personalised, or digital content supplied with the consumer's express consent). The full details, the method of exercising the right and the withdrawal form are set out in the dedicated "Withdrawal Policy" page.
To exercise the right of withdrawal, the Client may contact us at contact@btu.ro, following the procedure in the dedicated page.
Use of the services is subject to an Acceptable Use Policy (AUP), which establishes the permitted and prohibited activities on BTU infrastructure. The following are prohibited, by way of example:
The Provider makes every effort to ensure a service availability (uptime) of 99.9% per month, measured in accordance with our service level policy (SLA). Details on the calculation method, exclusions and any compensation are set out in the dedicated "SLA" page.
Certain interruptions are not counted when determining availability, such as planned maintenance (announced in advance), force majeure events, problems caused by the Client or their applications, and factors beyond the Provider's reasonable control.
The Client undertakes to use the services in good faith and in accordance with the law and these terms. In particular, the Client has the following obligations:
The services are provided "as is" and "as available". To the maximum extent permitted by law, the Provider is not liable for indirect damages, loss of data, loss of profit, loss of business opportunities or business interruptions resulting from the use of or inability to use the services.
The Provider's total liability towards the Client, on any basis, is limited to the amounts actually paid by the Client for the relevant service in the 12 months preceding the event giving rise to liability.
Nothing in these terms limits liability in situations where the law prohibits such limitation, including in cases of fraud or gross negligence, or in respect of mandatory consumer rights.
The Provider may suspend or terminate, wholly or partially, the services in the event of non-payment, breach of these terms or of the Acceptable Use Policy, well-founded suspicions of fraud, or at the request of the competent authorities. Where possible and given the circumstances, the Provider will notify the Client in advance.
The Client may cease using the services and may request termination according to the procedure in their account. Amounts relating to periods already paid are non-refundable, except as provided by law or the withdrawal policy.
Upon termination of the contract, the Provider may irreversibly delete the data associated with the service, following a possible grace period. It is the Client's responsibility to export their data before termination.
All intellectual property rights in the btu.ro website, the "BTU" brand, logos, interfaces, proprietary control panels, documentation and content belong to SND TEAM S.R.L. or its licensors and are protected by law. Nothing in these terms transfers any rights over them to the Client.
The Client retains all rights to their own content that they host, warranting that they hold the necessary rights and granting the Provider the limited technical licence required to provide the services (storage, transmission, backup).
The Provider is not liable for the non-performance or delayed performance of its obligations where this is due to force majeure or fortuitous events, such as: natural disasters, fires, major power outages, partner infrastructure failures, large-scale cyberattacks, armed conflicts, government restrictions or other events beyond reasonable control.
For the duration of the force majeure event, the affected obligations are suspended. If the situation persists for more than 30 days, either party may request termination of the contract for the affected services.
The processing of personal data is carried out in accordance with Regulation (EU) 2016/679 (GDPR) and applicable Romanian legislation. Details regarding the legal bases, purposes, storage duration and rights of data subjects are set out in the "Privacy Policy".
As a data subject, you are entitled, under the conditions of the law, to the following rights:
The Provider reserves the right to modify these Terms & Conditions to reflect legislative, technical or commercial changes. The updated version will be published on btu.ro, indicating the effective date.
For substantial changes affecting contracted services, the Client will be notified reasonably. Continued use of the services after the changes take effect constitutes acceptance thereof.
These Terms & Conditions are governed by Romanian law, including Law 365/2002 on electronic commerce, GEO 34/2014, Law 506/2004 and Regulation (EU) 2016/679. Any dispute will be resolved, as far as possible, amicably.
Consumers may turn to the National Authority for Consumer Protection (ANPC, www.anpc.ro). The European Online Dispute Resolution (ODR) platform is also available: https://ec.europa.eu/consumers/odr.
Failing amicable resolution, disputes shall fall under the jurisdiction of the competent Romanian courts at the Provider's registered office, subject to the mandatory rules on jurisdiction in consumer protection matters.
